1. What do these Food+ Promotional Terms cover?
1.1 Food+ is the Samsung Food premium subscription offering. These terms set out the basis on which we offer a Food+ subscription to you for free for a limited trial period with your purchase of a qualifying Samsung device. We refer to this promotional offer as our Food+ Bundle Promotion.
1.2 Please note that these terms only set out the basis of our Food+ Bundle Promotion and you are deemed to accept these terms where you apply to redeem a promotional code in order to participate in the promotion. However, any use you make of a Food+ or Samsung Food account, including during any free trial period, is governed instead by our User Terms which you can access here.
1.3 The Food+ Bundle Promotion is offered by Foodient Limited, trading as “Samsung Food” (we or us), in collaboration with Samsung Electronics Co.Limited. Foodient Limited trading as “Samsung Food” is a limited company registered in England and Wales with company number 8001091 and have our registered office at 483 Green Lanes, London, N13 4BS, United Kingdom. Our VAT number is 140606741. We are pleased to be part of the wider Samsung group of companies.
2. How the Food+ Bundle Promotion works
2.1 Who can take part? The Food+ Bundle Promotion is open to individuals over the age of 18 based in the EU and UK, who have purchased a qualifying Samsung device in the EU or the UK and who do not already have a subscription to Food+. If you have purchased a qualifying Samsung device and already have a Food+ subscription, then you will only be eligible to participate in the Food+ Bundle Promotion once your existing Food+ subscription expires. Please note that we reserve the right to reject your participation in the Food+ Bundle Promotion in circumstances where you are not eligible for a Food+ account, including for example where you have had a Samsung Food or Food+ account suspended or closed in the past.
2.2 Which Samsung devices qualify for the Food+ Bundle Promotion? For a full list of qualifying Samsung devices to which the Food+ Bundle Promotion applies please click here. We may change the list of qualifying Samsung devices from time to time without notification. The Food+ Bundle Promotion is not available in conjunction with Samsung devices not appearing on this list.
2.3 How to redeem your promotional code. Once you have purchased a qualifying Samsung device you will be directed to a webpage setting out how you can redeem your promotional code. As part of this process, you will be required to create a Samsung Food account and we will require evidence of purchase of your qualifying Samsung device to validate your eligibility for the Food+ Bundle Promotion.
2.4 Length of Food+ free trial period. The Food+ free trial period available to you may vary depending on the Samsung device purchased and the date of purchase. Please click here for further details.
2.5 How long will the Food+ Bundle Promotion last for? The Food+ Bundle Promotion starts on 01/28/2025. We may withdraw the Food+ Bundle Promotion from time to time at our discretion, and following which you will not be able to redeem any further promotional codes even if you have purchased a qualifying Samsung device prior to the promotion end date. We also reserve the right to alter or suspend the Food+ Bundle Promotion at any time. Withdrawing or ending the Food+ Bundle Promotion does not impact your free trial if your free trial has already commenced, however you will no longer be able to use any issued but unused promotional codes (i.e. where we have issued you with a code and you have not yet used it).
2.6 No monetary alternative. We will not offer any monetary alternative to any free trial Food+ subscription and nor will we offer a refund in the event your free trial is brought to an end early in accordance with our User Terms.
3. Cancelling or ending your free trial
3.1 Cancellation. You are free to cancel your free trial of Food+ at any time prior to the end of your free trial period. Our User Terms set out other rights we have to bring your Food+ subscription to an end.
3.2 At the end of your free trial period. Unless you cancel your Food+ subscription on or before the end of your free trial period, at the end of your free trial period your Food+ subscription will automatically continue on an annual or monthly basis (as selected by you when you open your Samsung Food account) and you will be responsible for paying to us the full Food+ subscription fee at our current rates until such time as you are entitled to terminate your subscription pursuant to the User Terms. 4. Our liability to you
4.1 If we fail to comply with these Terms, we are responsible for any loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence. Loss or damage is foreseeable if they were an obvious consequence of our breach or negligence. We do not accept liability for any loss or damage which was not foreseeable.
4.2 To the extent we may lawfully do so we exclude liability for any implied terms and conditions including those implied by statute, common law or the law of equity.
4.3 In addition to the above, we are not liable to you for any loss or damage you suffer as a result of any change to the Food+ Bundle Promotion or anything that is outside of our reasonable control.
4.4 However, nothing in these terms shall affect our liability for death or personal injury caused by our negligence, nor our liability for fraud or serious misrepresentation, nor any other liability which cannot be excluded or limited under applicable law.
4.5 You have legal rights as a consumer. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards office.
5. Information about you
We process information about you (including your personal data) in accordance with our Privacy Notice.
6. Other important terms
6.1 If any of these terms are or become invalid or contravene any law then the remaining provisions shall not be affected.
6.2 These terms are governed by English law. You and we both agree to submit to the non-exclusive jurisdiction of the English courts, although you may be able to make a claim against us in your local courts if mandatory local law allows.
6.3 No waiver shall constitute a waiver of any other terms. No failure by us to exercise a remedy shall constitute a waiver to subsequently exercise any remedy.
6.4 We may revise these terms at any time. You are expected to check these terms from time to time to take notice of any changes we make, as they are binding on you. Some of the provisions contained in these terms may also be superseded by provisions or notices published elsewhere on the Samsung Food Services or in our User Terms. If you do not agree to any changes made to these Terms, then you must refrain from continuing to use the Samsung Food Services or your Food+ subscription.
